المجلس الدستوري يرفض النظر في الطعنين المتعلقين بقانون الايجارات

قرر المجلس الدستوري السبت عدم النظر في الطعنين المقدمين بقانون الإيجارات لأن القانون نشر في الجريدة الرسمية "لم يكن نافذا".
وبذلك يكون المجلس قد رفض مراجعة رئيس الجمهورية المنتهية ولايته حاليا ميشال سليمان التي طلب فيها ابطال القانون المتعلق بالايجارات في ما يخص بعض احكامه، ومراجعة مجموعة من النواب الذين طلبوا وقف تنفيذ وإبطال قانون الايجارات برمته.
وكان قد تقدم سليمان في 19 أيار استنادا إلى المادة 19 من الدستور، بمراجعة لدى المجلس الدستوري للنظر بدستورية قانون الإيجارات، بعد أن رأى ان "أي قانون لا يوفر العدالة الاجتماعية يكون مجحفا في حق فئة معينة او فئة اخرى من المواطنين".
ورأى المجلس الدستوري في قراره اليوم السبت أن "النص المطعون فيه هو النص المنشور في الجريدة الرسمية بتاريخ 8/5/2014 وهو نشر في تاريخ لم يكن فيه القانون الذي أقره مجلس النواب قد أصبح نافذا حكما بموجب الفقرة الاخيرة من المادة 57 من الدستور".
ويترتب على ذلك بحسب المجلس "عدم توافر عناصر المادة المذكورة وبالتالي عدم نفاذ القانون".
عليه أعلن المجلس أن هذا "الواقع يحول دون النظر في دستورية قانون لم تكتمل عناصر تكوينه في تاريخ نشره، وهو بالتالي غير نافذ".
وقرر المجلس "بالاكثرية، عدم إمكان النظر في الطعنين المقدمين، لعدم نفاذ القانون المطعون فيه".
يذكر أن مشروع القانون أقر مطلع نيسان الفائت بمادة وحيدة كما عدلته لجنة الادارة والعدل منذ العام 2012 حيث لم يلق المشروع اي اعتراض نيابي من أي كتلة نيابية في ما خلا بعض الاعتراضات الفردية من قبل نواب رأوا فيه أنه يؤدي الى تفريغ سكاني ونزوح سكاني لا مثيل له.
وفيما يقول المستأجرون أن القانون غير منصف ويؤدي إلى تهجير عائلات وإلى "فرز ديمغرافي" كبير نظرا لمنع الإختلاط الذي كان قائما بين الناس منذ أعوام، يقول مالكو الأبنية أنه منصف ويفتح باب الحوار مع المستأجرين.

I dont understand this article. Can someone explain in plain english? where are we in the new rent law. Is it on or off?

The country run by big thieves that protect smaller thieves.....I mean for God sake what is their argument? We have tenants that through the years were able to acquire more than one property outside Grand Beirut, of course, and live high on the hog. But, then, pretend poverty when any laws are initiated. By the way, the increases considered in the new law are insignificant to an average rent property. So disgusted.... Really, some lebanese are so Jappy. Why is it hard for them to understand that if you cannot afford one area , you move to a lesser desirable one. This concept applies to all nations except to them.

It appears to be implying that until the law goes into effect, the constitutional court won't rule on it. But to go into effect, it needs the signature of the President... With no President yet, the counsel of ministers is tasked with this. But, since the cabinet has not yet agreed a mechanism for carrying out Presidential duties, it will likely be shelved and may even become an item for a tug of war between the politicians. All while our country is held hostage by HA and Aoun. Niyyalna!

1- The Constitutional Council decided on Saturday not to look into the two vetoes submitted against the new rent law, saying that the legal text published in the Official Gazette “was not put into effect
That in itself sums it up The council decided to ignore the vetoes simply because whatever was published was not put in effect meaning it was null and void

"Accordingly, the Council will not look into former President Michel Suleiman's veto against this law in which he demanded canceling some of its articles, neither into some MPs' demand of annulling the entire draft.
On May 19, then President Suleiman asked the Constitutional Council to look into the constitutionality of the new rent law, and into whether it adheres to Article 19 of the Constitution."
The article does say Suleiman vetoed the law.

no the new publishing the law do not require the president signiture nor the prime minister only will publish automtically because president do not sign it this is victory for landlords the new law is active
