How about a court where the prosecution can withhold evidence and still use it, only providing a "summary of key points" to the defense? How about a court where they can withhold exculpatory elements in case they threaten the "interests of a friend country" ?
How about anonymous witnesses that the defense cannot cross-interrogate?

as to your remark about withholding evidence, i am, again, talking about court proceedings, they can, during trial, say "we have evidence that incriminates you but we cant show it to you". they submit it ex-parte to the judges and the judges can use it in their verdict, but the defense will never see it. again, it's in the RPE, available on the official STL website

(iii) for any other reasons may be contrary to the public interest or the rights of third parties, the Prosecutor may apply ex parte to the Trial Chamber sitting in camera to be relieved in whole or in part of an obligation under the Rules to disclose that material.
