ينهي مشروع الدستور الجديد في سوريا الدور القيادي لحزب البعث ويحدد الولاية الرئاسية بسبع سنوات تجدد لمرة واحدة، فيما تواصل السلطات عملياتها العسكرية والامنية وسط مشاورات دولية لم تسفر عن نتيجة.

ويخلو مشروع الدستور الجديد الذي نشرت الوكالة نصه تمهيدا للاستفتاء عليه في 26 شباط، من ذكر اي دور قيادي لحزب البعث العربي الاشتراكي الذي يحكم البلاد منذ عام 1963 كما هي الحال في الدستور الحالي.

وتؤكد المادة الثامنة من مشروع الدستور الجديد ان "النظام السياسي للدولة يقوم على مبدأ التعددية السياسية وتتم ممارسة السلطة ديموقراطيا عبر الاقتراع".

وبحسب هذه المادة ايضا "تسهم الاحزاب السياسية المرخصة والتجمعات الانتخابية في الحياة السياسية الوطنية، وعليها احترام مبادئ السيادة الوطنية والديموقراطية".

وتحل هذه المادة مكان المادة الثامنة في الدستور الحالي التي تنص على ان حزب البعث الذي يحكم سوريا منذ 1963 هو "قائد الحزب والمجتمع".

وكان الغاء هذه المادة في صلب مطالب الحركة الاحتجاجية في سوريا لدى انطلاقها في اذار الماضي.

كما ينص المشروع على ان "ينتخب رئيس الجمهورية لمدة سبعة اعوام ميلادية تبدأ من تاريخ انتهاء ولاية الرئيس القائم ولا يجوز اعادة انتخاب رئيس الجمهورية الا لولاية واحدة تالية".

الا ان المادة السابعة والثمانون اشارت الى انه "إذا انتهت ولاية رئيس الجمهورية ولم يتم انتخاب رئيس جديد يستمر رئيس الجمهورية القائم بممارسة مهامه حتى انتخاب الرئيس الجديد".

وكان الدستور السابق المطبق منذ 1973 ينص على ترشيح رئيس الجمهورية من قبل "مجلس الشعب بناء على اقتراح القيادة القطرية لحزب البعث العربي الاشتراكي ويعرض الترشيح على المواطنين لاستفتائهم فيه".

وكان الاستفتاء الاخير اجري في ايار 2007، وايد بموجبه انتخاب الرئيس بشار الاسد (41 عاما) نجل الرئيس السابق حافظ الاسد لولاية جديدة من سبعة اعوام.

وحصل الاسد في الاستفتاء على 62،97% من الاصوات.

كما اعاد مشروع الدستور سن الترشح لرئاسة البلاد الى اربعين عاما بعد تعديله في العام 2000 على اثر وفاة الرئيس حافظ الاسد تم بموجبه تخفيض العمر الى 34 سنة للسماح لابنه بشار الاسد بتولي الرئاسة.

وينص المشروع ايضا على ان "دين الرئيس الاسلام والفقه الاسلامي مصدر رئيس للتشريع" مشيرا الى ان "الدولة تحترم جميع الأديان (...) وان الأحوال الشخصية للطوائف الدينية مصونة ومرعية".

ولكن المشروع لم يجز "مباشرة أي نشاط سياسي أو قيام أحزاب أو تجمعات سياسية على أساس ديني أو طائفي أو قبلي أو مناطقي أو فئوي أو مهني" ما يغلق الباب امام جماعة الاخوان المسلمين والاحزاب الكردي بممارسة العمل السياسي.

ولم تقنع هذه الاصلاحات المجتمع الدولي بسبب استمرار اعمال العنف في سوريا.

واكد مدير مركز كارنيغي للشرق الاوسط بول سالم لوكالة فرانس برس "من غير الواقعي اطلاق مثل هذه الاقتراحات واجراء استفتاء في حين ان المعارك على اشدها".

What more would the people of Syria ask for. The president in his glory has ordered the ratification of a new constitution. The people should drop to the ground and kiss his feet for giving them a constitution that will make their lives so fulfilled they couldn't sleep from happiness and joy. I commend Assad on this jesture and for the attention he gives to his people. Yes, he killed more than 10 thousands and imprisoned more than hundreds of thousands but this is besides the point because he was upholding the law which says that he should defend the people of Syria. Now the Syrian people can go to sleep and live in peace. Assad has proven once again that he's a real Assad full of mercy and compassion. I think other countries, such as Europe and the USA should copy this style of governance and style based on the best of the people.

the government said that the law was lifted, but kept the same regulations in place and required for example, that political protests required permission from the interior ministry to become legal. So, since they were illegal already, what really changed? You can take rat droppings, put them in pretty little boxes, and call them whatever you'd like. The Lybian constitution under Kaddafi was much more democratic than that, heck Kaddafi didnt have the title of president, yet that didn't stop him from being a defacto dictator for 40 years.
Bashar will put nice things on paper, but on the ground, any opposition threatening his power will be killed or imprisoned...that his view of multiparty system...other pseudo branches of his Ba'ath party will be put out for the show.

You say that the opposition isn't united and i reply by saying that it is a good thing. The current syrian regime only represents the alawite sect and the upper class on the other hand the opposition represents all facets and sects of the syrian population including alawites and druze. What this entails is that the opposition is as legitimate, if not more, than the current syrian regime. The same way that M8 accept hezbollah as a legitimate party, they should acknowledge the syrian opposition to be legitimate as well.
