صقر طلب استجواب مملوك و"عدنان" والإستماع لشعبان..ووكيل سماحة: لتطبيق الاصول القضائية بين لبنان وسوريا

طلب مفوض الحكومة لدى المحكمة العسكرية القاضي صقر صقر من قاضي التحقيق العسكري الاول رياض أبو غيدا استجواب المدعى عليهما اللواء السوري علي مملوك وسماحة وعقيد في الجيش السوري يدعى عدنان والاستماع الى افادة مستشارة الرئيس السوري بثينة شعبان بملف النائب والوزير السابق الموقوف ميشال سماحة.
وأبدى صقر مطالعته في ملف سماحة في جرم نقل متفجرات بسيارته من سوريا الى لبنان، وطلب ابلاغ المدعى عليهما علي مملوك وعدنان واستجوابهما والاستماع الى افادة شعبان كشاهدة.
يُشار الى ان صقر اعاد الملف الى القاضي ابو غيدا.
بدوره علق وكيل سماحة المحامي صخر الهاشم، على مطالعة صقر، فقال:"في ضوئها يقتضي تطبيق الأصول القضائية المتبعة بين لبنان وسوريا إستنادا الى الاتفاقيات الموقعة بين البلدين، وبالتالي لا يمكن إصدار قرارات قضائية للأشخاص المطلوبين، إلا إذا جرى إبلاغهم شخصيا ما لم يحضروا الى لبنان في تاريخ الجلسة، ويستوجب ابلاغ المدعى عليهم، إما بواسطة وزارة العدل أو وزارة الخارجية أو المجلس الأعلى اللبناني-السوري".
وشرح انه "لا يمكن إبلاغهم لصقا، إلا بعد إعادة التبليغ بعدم الحضور".
كما رأى الهاشم ان "الملف كان يسير مساره الطبيعي قبل إحالته الى المطالعة بعد ختم التحقيق".
والخميس الفائت، احال ابو غيدا الملف الى صقر لابداء المطالعة في الاساس تمهيدا لاصدار القرار الاتهامي.
ومطلع الشهر الفائت، افادت معلومات صحفية ان "شعبة المعلومات رفعت محضرا اضافيا الى المحاضر التابعة لقضية سماحه يتضمن اسم شعبان رفعته الى النيابة العامة العسكرية لتحوله بعد درسه الى قاضي التحقيق العسكري".
ويتضمن الملف المقدم، وفق المعلومات، "تحليل لاتصالات ومكالمات هاتفية اجراها سماحه اثناء وجوده في دمشق، تثبت تورط بثينة شعبان ومعرفتها بما يخطط له كل من اللواء علي مملوك والوزير سماحه من نقل للمتفجرات وتفجيرها شمال لبنان".
ويُذكر ان القضاء، ادعى في 11 آب الماضي على ملوك وسماحة وعدنان "بجرم تأليف جمعية بقصد ارتكاب الجنايات على الناس والاموال والنيل من سلطة الدولة وهيبتها واثارة الاقتتال الطائفي عبر القيام باعمال ارهابية بواسطة عبوات ناسفة تولى سماحة نقلها وتخزينها بعد ان جهزت من مملوك وعدنان".

If we were given a chance to make peace with it would have provided a secular ally to lebanon? There is not one letter in that statement that is true. Are you lebaneses?
